The following terms and conditions apply to all clients who use the services offered by Body Balance Personal Traning (hereinafter “BBPT”).

  1. General
    a) You become a client of BBPT as soon as you sign a training agreement (hereinafter “client”).
  2. Terms and Conditions
    a) These terms and conditions apply to all services provided by BBPT.
    b) BBPT is entitled to amend the applicable terms and conditions. Amendments shall take effect one calendar month after publication, unless a different statutory period is required, which shall be applied in such case. if a client does not wish to accept an amendment that is detrimental to him, he may terminate his membership with effect from the date on which the new terms and conditions take effect. Written notice of termination must be received by BBPT before the effective date of the change.
  3. Personal Training
    a) Clients may enter into a personal training agreement with BBPT. Personal training is a customized training program on an individual basis. b) An agreement with BBPT for personal training is strictly personal and cannot be transferred to third parties. c) The total amount (or in consultation the first term) of the agreement must be paid in full before the start of the first training session. d) Personal training takes place according to the Personal Training formula as indicated in the agreement. e) The number of hours to be followed for the Personal Training Formula must have taken place within the duration indicated in the agreement. f) Appointments must be cancelled no later than 24 hours in advance. If an appointment is cancelled within 24 hours in advance, the client thereby forfeits the right to make up the appointment at a later date.
    g) The agreement can run for a maximum of one month, after which any remaining hours cannot be made up.
    h) In the event of a serious injury or if the client has to undergo an operation, it is possible to terminate the agreement for one month, provided this is reported to BBPT within two weeks, by means of a doctor’s statement. If you do not contact BBPT, it is assumed that you have recovered. This agreement will then be reactivated. Please note, there must be a serious injury such as fractures, muscle tears, etc. so that you cannot engage in any physical activity. In case of fatigue, colds, etc. it is not possible to stop your agreement.
    i) Body Balance PT reserves the right to refuse reservations or to dissolve the relationship (customer) with immediate effect, when the customer repeatedly does not show up according to appointment or after repeatedly canceling exceeds the contract term. Without being held to any form of compensation and without a notice of default being required. (Partial) restitution of the amount paid shall never take place in this case.
    j) In the event that BBPT is temporarily unable to fulfill its obligation due to force majeure, BBPT shall be entitled, without judicial intervention, to suspend its obligation for as long as the situation causing the force majeure continues. If compliance is permanently impossible due to force majeure, BBPT shall provide a replacement personal trainer of equal quality. Only if BBPT is unable to provide a substitute trainer, shall the amount paid be refunded on a pro rata basis.

  4. Four-On-One / More-On-One
    a) Clients can enter into a training agreement with BBPT.
    b) An agreement with BBPT is strictly personal and cannot be transferred to third parties.
    c) The total amount is debited monthly by direct debit.
    d) Appointments must be cancelled no later than 24 hours in advance. If an appointment is cancelled within 24 hours in advance, the client thereby forfeits the right to make up the appointment at a later date.
    e) In the event of a serious injury or if the client has to undergo surgery, it is possible to terminate the agreement for one month, provided this is reported to BBPT within two weeks, by means of a doctor’s statement. If you do not contact BBPT, it is assumed that you have recovered. This agreement will then be reactivated. Please note, there must be a serious injury such as fractures, muscle tears, etc. so that you cannot engage in any physical activity. In case of fatigue, colds, etc. it is not possible to terminate your agreement.
    f) The subscription is automatically renewed on a monthly basis.
    g) Cancellation can be done monthly before the 15th of the month by email to info@bbpt.nl.
  5. Privacy
    a) BBPT processes Client’s personal data within the framework of the applicable privacy laws and regulations, in particular the Personal Data Protection Act, in a manner and for the purposes specified below.
    (b) BBPT processes personal data for the purposes of: billing, accounts receivable administration, complaint handling and dispute resolution, information to the participant’s employer about the use of membership, for the prevention, detection and combating of fraud and irregularities.
    (c) The Client has a right of inspection, correction and objection with respect to the personal data processed about him. BBPT may charge a fee for inspection and/or making corrections and/or for handling an objection up to the statutory maximum. The Client may address an objection to the processing of his personal data and requests for inspection, correction and opposition to BBPT.
  6. Electronic Access Key (Hereinafter: Tag)
    a) Client who enters into a personal training agreement with BBPT obtains a TAG for access to BBPT’s premises during times determined by BBPT. These times can be found on BBPT’s website.
    b) The TAG remains the property of BBPT and is strictly personal. A deposit of 25 euros is paid for this TAG.
    c) BBPT is authorized to deny client access to the premises in the event of misuse of the TAG.
    d) Loss or theft of the TAG must be reported to BBPT immediately. BBPT will charge client for the cost of a new TAG.
  7. Liability
    a) The Client understands that physical activity may result in possible injury or other complications without this arising from negligent action on the part of BBPT. BBPT shall never be liable for any indirect damage suffered by the user or third parties, including consequential damage, loss of income, loss of data, damage as a result of incorrect or incomplete information, damage as a result of unsuitability of prescribed or supplied instructions. The client is obliged to report pain, discomfort af abnormal fatigue before, during and after the training as well as changes in his physical condition during the duration of the agreement.
    b) Each client is personally responsible for personal accidents and his personal belongings. The client is advised to take out adequate insurance for this purpose. Neither the company nor its employees can be held responsible for the loss, damage or theft of goods on the territory of BBPT.
  8. House Rules
    a) Client is familiar with the house rules applied by BBPT. These house rules are available at BBPT and can be requested upon request. The Client is obliged to comply with these house rules.
    b) BBPT may refuse or deny access at any time to persons whose behavior gives cause to do so.
  9. Final Provisions
    a) All membership agreements entered into by the firm are governed by Dutch law.
    b) Agreements between client and BBPT can only be entered into in writing, and can only be amended in writing.
    c) If any of the above provisions are invalid or unlawful, the remaining provisions shall continue to apply.
